Terms of Service

1. Warranty and Liability
Fusion Computer Support (FCS) warrants that services will be performed in a professional and timely manner. All services are warranted for a period of 7 days at the discretion of FCS. There is NO warranty for removal of viruses, spyware, adware or malware. FCS is not liable for any damages, costs, and expenses incurred as a result of any defect or damage to any hardware, software or data residing or recorded in the customer’s computer or backup device, whether incurred during the course of services or otherwise. If service involves transferring information or installing software, the customer is assumed to have the legal right to copy the information, to use the software and agree to the terms of the software license, and the customer authorizes FCS to transfer the information and accept such terms on your behalf in performing the service.

2. Responsibility
It is the customer’s responsibility to back up all software and data on their computer’s hard drive(s) and/or any other storage devices before the FCS technician performs service. FCS shall not be responsible at any time for any loss, alteration, or corruption of any software, data, or files. FCS is not responsible for the ongoing computer hardware, firmware and software updates or license renewals and will only perform such updates or renewals if requested by the customer. FCS will make every effort to make the customer aware of any updates or renewals that are necessary as a courtesy but it is the customer’s responsibility to make sure their computer hardware and software is updated and any software licenses are renewed whether by the customer or by requesting FCS to perform such services.

3. Security
Fusion Computer Support (FCS) makes every effort to protect the customer’s hardware, software and data from malicious attacks meant to do damage hardware, software or to gain access to sensitive data. FCS cannot be held liable for any breach in security whether internally or from external sources via local area network, wide area network or wireless devices.

IMPORTANT:
IF ANY DAMAGE SHOULD OCCUR WHILE THE COMPUTER OR OTHER RELATED HARDWARE IS BEING SERVICED, FUSION COMPUTER SUPPORT HAS NO LIABILITY FOR THE COST OF REPAIR OF THE AFFECTED COMPUTER. FUSION COMPUTER SUPPORT’S ENTIRE LIABILITY TO THE CUSTOMER FOR DAMAGES ARISING FROM ANY CAUSE WHATSOEVER, WITH RESPECT TO THE SERVICE OF THE COMPUTER OR OTHER RELATED HARDWARE IS LIMITED TO THE AMOUNT THAT THE CUSTOMER PAID FCS FOR THAT SERVICE CALL. FUSION COMPUTER SUPPORT HAS NO LIABILITY WHATSOEVER FOR INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF USE, LOST PROFITS OR REVENUE, OR ANY OTHER DAMAGES NOT OTHERWISE EXPRESSLY PERMITTED UNDER THIS AGREEMENT. FUSION COMPUTER SUPPORT ALSO HAS NO LIABILITY FOR LOSS OF OR DAMAGE TO DATA OR SOFTWARE APPLICATIONS WHILE PERFORMING SERVICE. IT IS THE CUSTOMERS RESPONSIBILITY TO MAINTAIN COPIES OF ALL IMPORTANT INFORMATION ON THEIR COMPUTER PRIOR TO AUTHORIZING FUSION COMPUTER SUPPORT TO PERFORM ANY SERVICES.
